[Cookidea] Terms of Service

Welcome to [Cookidea] (the "Service" or the "App"). This Service is provided by [SPARKLECT CO., LTD.] ("we", "us", or "our").

Please read these Terms carefully before using the Service. By registering an account, you acknowledge that you have read, understood, and agreed to all terms below.

1. Nature and Scope of the Service

The Service uses artificial intelligence (LLM) technology to generate recipe suggestions and cooking guidance based on user inputs and preferences.

  • AI-generated content: Recipes, cooking steps, calorie estimates, and ingredient portions provided by the Service are automatically generated by AI models and are for reference only. They do not constitute professional advice from a licensed dietitian or chef.
  • Feature differences: The Service offers different account tiers, including Free Membership and Paid Subscription Membership, each with different feature access rights (see Section 3).

2. Safety Warning and AI Disclaimer (Important)

Because the core functionality is AI-generated, we do not guarantee the absolute accuracy, completeness, or safety of generated content. By using the Service, you agree to assume the following risks:

  • Food safety: Users are responsible for evaluating ingredient freshness, handling methods, and cooking doneness. The Service is not legally liable for food poisoning, physical discomfort, allergic reactions, or any related harm resulting from cooking based on AI-generated recipes.
  • Kitchen safety: Cooking involves fire, knives, and high-temperature equipment. Users must exercise caution during operation. The Service is not responsible for accidental injuries occurring during cooking.
  • Data accuracy: AI-provided calorie tables, estimated times, and ingredient portions are algorithmic estimates, not laboratory-grade measurements, and must not be used as the sole basis for medical dietary control.

3. Membership Plans and Benefits

The Service provides different membership plans (e.g., free members and paid subscribers).

Plan details: including specific benefits, feature limits, quota deduction rules, and ad display methods, are governed by the plan description shown in the App at the time of use. We reserve the right to adjust plan content and values at any time.

4. Subscription and Payment Policy

4.1 Subscription fees

  • Subscription pricing, billing cycles (e.g., monthly or annual), and promotional offers are subject to the information shown in the app store (App Store / Google Play) and the in-app purchase page.
  • Prices may change due to exchange rate fluctuations, regional tax laws, or promotional campaigns.

4.2 Auto-renewal

Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Charges will be billed to your App Store or Google Play account within 24 hours prior to the end of the current period.

4.3 Cancellation

You may manage or cancel your subscription at any time through your app store account settings. After cancellation, benefits remain available until the end of the current billing period.

4.4 Refunds

All subscription transactions are processed by the app store platform (Apple / Google). The Service cannot issue refunds directly. Please follow the relevant platform refund policy.

5. Fair Use Policy

To protect generation speed and service quality for all users and prevent malicious abuse of system resources, the Service enforces traffic and usage limiting mechanisms:

  • Dynamic limits: The Service may apply dynamic caps based on API request frequency, generation volume, or computational resource consumption. These limits apply to all users, including free and paid members.
  • Effects when triggered: When usage reaches system-defined thresholds, the Service may temporarily restrict generation access, reduce generation speed, or ask you to try again later.
  • Rule adjustments: Limit quotas, calculation cycles, and reset times may be adjusted dynamically based on system load without individual prior notice.

You agree these limits are necessary measures to maintain service stability and do not constitute breach of contract or impairment of rights.

6. Intellectual Property

6.1 App rights

The Service interface design, source code, database structure, and trademarks are owned by us.

6.2 Ownership of generated content

  • You understand and agree that all recipe content generated through the Service (including but not limited to text, data, step descriptions, and derivative information) is owned by us, including all related intellectual property rights.
  • We grant you an open, non-exclusive license to freely use, copy, modify, publicly publish, and commercially exploit content generated through the Service without restriction.

6.3 Company usage rights

For service optimization and promotion, you agree that we may permanently, royalty-free, and globally use, copy, modify, publicly transmit, and publicly publish content you generate (for example, featuring popular recipes in curated in-app lists, advertising campaigns, or a public recipe database) without additional notice or payment.

7. Service Changes and Termination

We reserve the right to modify, suspend, or terminate any part or all functionality of the Service at any time. Material changes will be announced in the App.
